By accessing or using DukaMoja ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations of the Republic of Kenya. If you do not agree with any of these terms, you are prohibited from using or accessing the Platform. DukaMoja Limited reserves the right to update these Terms at any time, with notice provided via email and Platform announcements.
DukaMoja is a multi-vendor e-commerce marketplace that connects buyers with verified vendors across Kenya. DukaMoja acts as an intermediary marketplace operator and escrow agent — it is not a party to transactions between buyers and vendors. DukaMoja uses official Safaricom Daraja endpoints for M-Pesa payment collection, SasaPay Wallet as a Service for user and vendor wallet infrastructure, and Blnk for ledger management.
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify DukaMoja immediately of any unauthorized use of your account. DukaMoja reserves the right to terminate accounts that violate these Terms.
Buyers may browse and purchase products listed by verified vendors. By placing an order, you agree to pay the listed price plus applicable delivery fees. All payments are processed via M-Pesa and held in escrow until you confirm delivery. You have 14 days from delivery to raise a return or dispute. DukaMoja does not guarantee the quality or accuracy of vendor listings but will mediate disputes in good faith.
Vendors must complete identity verification (KYC) before listing products. By listing on DukaMoja, vendors represent that they have the right to sell the listed items and that items are accurately described. Vendors must dispatch orders within 48 hours of confirmation. Vendor commissions are deducted from each payout as per the agreed rate. Refer to the Vendor Agreement for full vendor obligations.
Users may not: (a) use the Platform for any unlawful purpose; (b) list or sell counterfeit, stolen, or prohibited goods; (c) manipulate prices or engage in deceptive practices; (d) harass or harm other users; (e) attempt to circumvent the escrow system; (f) submit false dispute claims; (g) reverse-engineer or scrape the Platform; or (h) use the Platform to distribute malware or spam.
DukaMoja collects buyer payments through official Safaricom Daraja M-Pesa endpoints and records escrow movement in the platform ledger. SasaPay is used only for Wallet as a Service account infrastructure. Funds are released to vendors 7 days after delivery confirmation or upon buyer acceptance, whichever is earlier. In the event of a dispute, funds remain in escrow until resolution. DukaMoja charges vendor commissions as disclosed in the Vendor Agreement. DukaMoja is not responsible for M-Pesa network failures beyond its control.
The DukaMoja brand, logo, and Platform content (excluding vendor content) are the intellectual property of DukaMoja Limited. Users may not reproduce, distribute, or create derivative works from DukaMoja's IP without written consent. Vendors retain ownership of their product content but grant DukaMoja a license to use it for Platform operation and marketing.
DukaMoja processes personal data in accordance with the Kenya Data Protection Act (2019) and our Privacy Policy. By using the Platform, you consent to the collection and use of your data as described in the Privacy Policy. DukaMoja does not sell personal data to third parties.
The Platform is provided on an 'as is' basis. DukaMoja disclaims all warranties, express or implied. To the maximum extent permitted by Kenyan law, DukaMoja's liability for any claim arising from use of the Platform is limited to the amount paid by the user in the 3 months preceding the claim. DukaMoja is not liable for indirect, incidental, or consequential damages.
Any dispute arising from these Terms shall first be submitted to DukaMoja's support team for resolution. If unresolved within 14 days, disputes shall be submitted to mediation under the Nairobi Centre for International Arbitration rules. These Terms are governed by the laws of the Republic of Kenya.
